§ 74-3. Indemnification for city.

  • The wrecker owner of all auto wreckers doing business in the city shall sign an affidavit of continuing indemnification having substantially the following provisions:

    "The wrecker owner shall indemnify and save harmless the city, its officers and employees from any and all claims, losses, damages, injuries, liability, costs and expenses of whatsoever kind in nature (including reasonable attorney fees). However, the same may be caused, whether resulting directly or indirectly from the use of said wrecker under the terms and conditions of this chapter and without limiting the generality of the foregoing, the same shall include injury or death to any person, or persons, and damage to any property including that of the city and/or parish. In the event that the liability of the wrecker owner shall arise a reason for the sole negligence of the city, its agents, servants or employees, then, and only then, the operator shall not be liable under the provisions of this paragraph."
