§ 74-1. Authority to summon wreckers.

  • (a)

    The city police department, or any other law enforcement official, shall have authority over all accident scenes and shall summon all wreckers in any case where law enforcement is required to direct the removal, towing and/or storage of motor vehicles from the public streets, places and/or private property, including, but not limited to, the removal, towing and/or storage of automobiles which have been involved in traffic or other accidents, vehicles which have otherwise become disabled, vehicles being impounded or otherwise held in connection with criminal investigations and vehicles removed because of parking or other similar violations; such removal, towing and/or storage shall be carried out by an emergency wrecker or heavy duty wrecker as the situation may require.

    (b)

    In any case where public safety considerations permit, and where the vehicle operator specifically requests that a particular wrecker service provide for the removal, towing and/or storage of his vehicle, the vehicle operator's request shall be honored. However, where public health, safety and welfare require the immediate and direct removal, then the law enforcement personnel may call a wrecker in their discretion as hereinafter set out.
