§ 6-168. Registration.

  • (a)

    No person shall be hired to perform as an exotic dancer in any retail establishment dealing in alcoholic beverages of low or high content without having been registered by the chief of police and without having complied with the provisions of this section. Each person holding a certificate of registration shall have that certificate in the licensed establishment or in his immediate possession at all times when performing as an exotic dancer and shall exhibit it upon demand of any police officer.

    (b)

    Each applicant for a certificate of registration to perform as an exotic dancer shall be photographed by the chief of police, or his designee, and shall be fingerprinted by the city police department.

    (c)

    Each applicant shall pay to the chief of police at the time of issuing such certificate of registration a fee, made payable to the city, to cover the cost of issuing such certificate; and such certificate shall be valid for a period of one year, unless sooner revoked, canceled or suspended, and shall expire one year from the date certificate is issued. The amount of the fee shall be as established by the mayor and council from time to time.

    (d)

    Each application shall be made at the offices of the city police department between 9:00 a.m. and 4:00 p.m., Monday through Friday. Upon receiving the application, the chief of police shall issue the certificate of registration no later than the end of the next day. If the certificate of registration cannot be issued on the day of the application, then an applicant who has applied before noon on any business day shall be automatically given permission to perform as an exotic dancer for up to 48 hours by:

    (1)

    Completing and signing the application form for a certificate of registration; and

    (2)

    Providing the city police department with a Xerox copy of the applicant's current valid driver's license.

    (e)

    Each certificate holder shall notify the chief of police, or his designated representative, of any change of residence address or any change of place of employment within 24 hours of such change. If any certificate holder shall be employed in more than one place, he shall so notify the police department.

    (f)

    The application for a certificate of registration shall be in writing and sworn to, and shall contain the full name and correct address of the applicant and any other pertinent information requested.

    (g)

    Any person convicted of performing as an exotic dancer without having a certificate of registration to do so shall be punished by a fine of not more than $250.00 or imprisonment of not more than 15 days, or both at the discretion of the judge.

    (h)

    Any person holding a license to sell low or high alcoholic beverages at retail from a bar shall be subject to suspension or revocation of his license if convicted of hiring unregistered exotic dancers in his establishment.
